2) Eligibility

This sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees, officers, and directors of Sponsor, and members of their immediate family and household (defined as people residing at the same physical address), are not eligible.

Void in Puerto Rico, U.S. territories, and where prohibited or restricted by law.

3) Sweepstakes Period

The sweepstakes begins on February 21, 2026 at 10:00 AM HST and ends on March 1, 2026 at 11:59 PM HST (the “Sweepstakes Period”).

Sponsor’s computer is the official timekeeping device.

4) How to Enter

Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding. No purchase or payment is required to enter or win. You may enter during the Sweepstakes Period by completing one or both entry methods below.

A) Instagram Entry (5 winners selected from the Instagram entry pool) To enter on Instagram, you must:

1. Like the designated giveaway post on Instagram (the “IG Post”)

2. Follow @kailuahisurftees on Instagram

3. Comment on the IG Post with “mālama ʻāina” or “malama aina”. Tagging a friend in the same comment is optional but encouraged.

B) TikTok Entry (5 winners selected from the TikTok entry pool) To enter on TikTok, you must:

1. Like the designated giveaway post on TikTok (the “TikTok Post”)

2. Follow @kailua.hi.surf.tees on TikTok

3. Comment on the TikTok Post with “mālama ʻāina” or “malama aina”. Tagging a friend in the same comment is optional but encouraged.

Entry requirements (all methods):

• Visibility & Timing: Entries must be received and viewable during the Sweepstakes Period; comments edited or deleted after the period (or before Sponsor’s review) may be disqualified. Your account must be public and in good standing (meaning not restricted, suspended, or limited such that the entry cannot be viewed or the winner cannot be contacted) on the platform at the time of review and notification. Your entry comment must be publicly viewable. Sponsor is not responsible for privacy settings, comment filtering, platform outages, platform moderation actions (such as comment removals, account restrictions, or shadowbans), or other issues that prevent Sponsor from viewing an entry. Following Sponsor’s account and liking the post are part of the free entry process and do not constitute a purchase.

• Automation: Entries generated by script, macro, bot, artificial means, or other automated methods are void.

Content guidelines: Do not include unlawful, unsafe, hateful, threatening, or obscene content in your comment. Sponsor may disqualify entries that are inappropriate or inconsistent with these Official Rules.

5) Entry Limits

Limit one (1) entry per person per platform during the Sweepstakes Period (one on Instagram and one on TikTok maximum). Multiple comments do not increase chances of winning.

A “person” is defined by the social account used to enter. Use of multiple accounts by the same individual to exceed the entry limit is not permitted. Sponsor may, in its sole discretion, treat entries as made by the same person if they appear to be controlled by the same individual. Sponsor reserves the right to request proof of identity or account ownership. Sponsor may disqualify any entrant who attempts to circumvent these limits.

6) Prizes and Approximate Retail Value

There will be ten (10) winners total:

• Five (5) winners selected from the Instagram entry pool
  

• Five (5) winners selected from the TikTok entry pool
  

Each winner will receive one (1) Humuhumunukunukuāpuaʻa tee (size subject to availability). If a winner’s requested size is unavailable, Sponsor will provide the closest available size or allow the winner to choose from available sizes (as determined by Sponsor).

Approximate Retail Value (ARV): $43 each

Total ARV of all prizes: $430

No substitution, cash redemption, or transfer of prizes is permitted, except Sponsor may substitute a prize of equal or greater value if a prize becomes unavailable.

Limit one (1) prize per person and per household. If an entrant is selected as a potential winner in more than one drawing/pool, Sponsor will award only one (1) prize and will select an alternate winner for the other drawing(s).

Prizes will ship within 2–4 weeks after winner verification. If a prize is returned as undeliverable, the winner may forfeit the prize and an alternate winner may be selected.

7) Winner Selection and Odds

Winner selection will be conducted by Sponsor (or a designated administrator) using a random method from the eligible entry list for each platform. Winners will be selected in random drawings from all eligible entries received during the Sweepstakes Period for each entry pool (Instagram pool and TikTok pool). Odds of winning depend on the number of eligible entries received in each pool. 

8) Winner Notification and Verification

Sponsor will make reasonable attempts (defined as up to two direct messages) to notify potential winners via direct message on the platform used to enter (Instagram DM for IG winners, TikTok DM for TikTok winners) starting on or about March 3, 2026. Entrants are responsible for monitoring their direct messages, including "message requests" and spam folders.

If a potential winner’s DMs are disabled or Sponsor cannot reach them, Sponsor may comment publicly on the winner’s entry asking them to direct message Sponsor. For privacy and security, Sponsor will never request sensitive or personal information (such as shipping addresses or payment details) via public comment; winners must provide such details only via secure direct message or Sponsor's official email (humusweeps@kailuahisurftees.com). Sponsor will never ask a winner to pay money to claim or receive a prize.If contact still cannot be established, or if a selected entrant is found to be ineligible or fails to comply with these Official Rules, they will be disqualified and an alternate winner will be selected. Sponsor may select up to three (3) alternate winners per prize before the prize is forfeited and remains unawarded.

Potential winners must respond within 48 hours (or the time stated in the notification) and may be required to provide:

• Full name
  

• Shipping address within the United States
  

• Tee color preference

• Graphic design color preference

• Tee style preference
  

• Proof of eligibility (including age and residency), if requested
  

Sponsor may require a potential winner to sign and return an Affidavit of Eligibility, Liability Release, and (where lawful) Publicity Release within the time specified by Sponsor. If a potential winner does not respond in time, is found ineligible, cannot be contacted, fails to provide required information, or fails to timely return required documents, the potential winner may be disqualified and an alternate winner may be selected.

9) Shipping, Taxes, and Other Costs

Sponsor will ship prizes to winners at a U.S. address provided by the winner. Sponsor is not responsible for lost, late, or misdelivered shipments due to incorrect or incomplete addresses.

Winners are responsible for any federal, state, or local taxes and any other costs not specifically stated as included. Sponsor will issue any tax forms required by law. Winners may be required to provide additional information for tax reporting purposes.

10) Publicity

Except where prohibited, entry constitutes permission for Sponsor to use the winner’s name, handle, and (if applicable) their public comments about the giveaway for promotional purposes in any media without further payment, notice, or consent.

11) Release and Limitation of Liability

By participating, entrants agree to release and hold harmless Sponsor and its affiliates, and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”), from any claim or cause of action arising out of participation in the sweepstakes or receipt or use of any prize, including but not limited to technical failures, unauthorized human intervention, platform or device issues, comment filtering, printing errors, mail or delivery issues, or errors in the administration of the sweepstakes.

The Released Parties are not responsible for entries that are lost, late, incomplete, invalid, unintelligible, or misdirected, or for any platform outages, DM restrictions, privacy settings, or other issues that prevent Sponsor from viewing an entry.

12) Platform Disclosures and Platform Release

This sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram. This sweepstakes is in no way sponsored, endorsed, administered by, or associated with TikTok. Instagram and TikTok are not responsible for the administration of this promotion.

You understand that you are providing your information to Sponsor and not to Instagram or TikTok.

Release of Platforms. By entering, you agree to release and hold harmless Instagram and TikTok from any and all liability arising from or related to this sweepstakes.

13) Privacy

Sponsor will use information collected from entrants and winners only for the purpose of administering this sweepstakes (including verifying eligibility, contacting winners, and prize fulfillment), except as otherwise permitted in these rules. Entrants’ platform handles and comments may be processed as part of entry administration; winner information may be retained for recordkeeping and compliance purposes. Sponsor’s Privacy Policy applies to personal information collected by Sponsor and is available at: https://kailuahisurftees.com/policies/privacy-policy 

14) General Conditions

Sponsor’s decisions are final and binding in all matters related to this sweepstakes. Sponsor reserves the right, in its sole discretion, to:

• Disqualify any individual it finds to be tampering with the entry process or the operation of the sweepstakes, acting in violation of these Official Rules, or acting in an unsportsmanlike or disruptive manner. Sponsor also reserves the right to disqualify any entries generated by automated means or any attempts to exceed the entry limits.

• Cancel, modify, or suspend the sweepstakes if technical failures, fraud, or any other factor beyond Sponsor's reasonable control impairs the integrity of the sweepstakes. If the designated IG Post or TikTok Post is removed, comments are disabled, or platform functionality changes, Sponsor may extend, move, or modify the entry process in a manner intended to be fair, and will announce changes via Sponsor’s official account.

Disputes: Entrants agree that any disputes, claims, and causes of action arising out of this sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate courts located in Hawaii. Entrants waive any right to a trial by jury for any dispute related to the sweepstakes.

Limitation of Remedies: To the maximum extent permitted by law, any claim is limited to actual out-of-pocket costs directly related to entering the sweepstakes (which typically equals $0), explicitly excluding travel or time costs. Entrants waive the right to claim punitive, incidental, consequential, special, or indirect damages against the Released Parties. Entrants also waive any right to claim attorneys’ fees. Nothing in these Official Rules limits any consumer rights that cannot be waived under applicable law.

15) Winners List

For a list of the verified winners (providing first name, last initial, and state of residence), available after verification is complete and after March 5, 2026, send an email to humusweeps@kailuahisurftees.com with the subject line: "Humu Tee Sweepstakes Winners List Request." All requests must be received by April 1, 2026.

16) Governing Law and Severability

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Hawaii, without giving effect to any choice of law or conflict of law rules. If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remainder of these rules, which will otherwise remain in full force and effect. The limitation of remedies and damages applies to the fullest extent permitted by law. These Official Rules constitute the entire agreement regarding the sweepstakes. In the event of any conflict or inconsistency between any sweepstakes-related promotional materials (including social media posts, captions, videos, or graphics) and these Official Rules, the terms of these Official Rules shall govern and control.
